Independence Declaration

I am an independent real-estate sales agent / professional, registered on the FlatCount.com marketplace and carrying on my own business on my own account and at my own risk. I find and source my own buyers entirely through my own efforts, at my own cost and risk (for example, my own marketing, campaigns, network or referrals). FlatCount.com does not provide me with any buyers, leads or enquiries. I use the FlatCount.com platform only to register the bookings I generate for the projects listed there. FlatCount.com's engagement with me is on a principal-to-principal basis.

I am not an employee, worker, agent, partner, joint-venturer or representative of FlatCount.com. Nothing in my engagement creates an employer–employee relationship. I am not entitled to, and will not claim, any salary or wages, provident fund (EPF), Employees' State Insurance (ESI), gratuity, bonus, paid leave, insurance, or any other employee benefit from FlatCount.com.

I decide how, when and where I work. I use my own resources, devices and contacts, and I bear my own business expenses, travel and overheads. FlatCount.com does not control the manner in which I perform my work.

I hold, or will obtain and keep current, all registrations and licences required for my activity, including registration under the Real Estate (Regulation and Development) Act, 2016 (RERA) where applicable, and I comply with all laws that apply to me.

I am solely responsible for my own taxes, including income tax and GST, and for filing my returns and paying my statutory dues. I understand FlatCount.com will deduct TDS under Section 194H of the Income-tax Act, 1961 and account for GST as required by law.

I have no authority to bind, make commitments or representations on behalf of, accept money on behalf of, or incur any liability for FlatCount.com or any Developer. I will not hold myself out as having any such authority.

I will not represent myself as an employee or agent of FlatCount.com, and I will use the FlatCount.com name and brand only as expressly permitted.

I am free to provide services to others and am not exclusively engaged by FlatCount.com. FlatCount.com does not guarantee me any minimum business, sales or income.

I understand that my commission is success-based, becomes payable only after the Developer pays the corresponding amount to FlatCount.com, and is not a guaranteed wage, salary or retainer.

The above is true and correct. I understand that FlatCount.com relies on this Declaration, and that a false declaration may lead to suspension or termination of my account and recovery of any amounts wrongly paid to me.
